Kyle Curtis Simmons LLC, a Nevada limited liability d/b/a The Kyle Simmons Team ("KST" "us" or "we") are dedicated to protecting your privacy and handling any personally identifiable information we obtain from you with care and respect.

This Privacy Policy sets forth our policy with respect to information, including personally identifiable information that is collected from users who enter or claim a prize in one of the KST Sweepstakes ("Sweepstakes").

This Privacy Policy applies to personally identifiable information collected through the Sweepstakes and does not apply to any other information collected by KST through any other means.

When this Privacy Policy uses the term "personally identifiable information," we mean information that identifies a particular individual, such as the individual's name, address, e-mail, and phone number. Personally identifiable information is also referred to in this Privacy Policy as "Personal Information."

As used in this Privacy Policy, KST includes all of its subsidiary and affiliated entities. KST is referred to in this Privacy Policy as "we," "us," "our," and "ourselves."

This Privacy Policy does not cover the information practices of other companies and organizations who advertise our services, and who may use cookies, web beacons (pixel tags), and other methodologies to serve personalized ads.

BY PARTICIPATING IN THE SWEEPSTAKES, YOU UNDERSTAND AND ACKNOWLEDGE THAT WE WILL COLLECT AND USE YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY.

Collection of Personal Information

The Personal Information we receive comes directly from users like you who are interested in participating in the Sweepstakes.

The Personal Information we collect includes without limitation:

• contact information, including name, email address, mailing address, age, date of birth and phone number
• commercial information including records of sweepstakes entered
• survey information you provide as part of a sweepstakes entry
• preferences information such as the types of emails you would like to receive from us
• promotional offers you may be interested in
• Other personal information you voluntarily provide to us

Use of Personal Information

We may use your Personal Information in many ways, such as to enter you into a sweepstakes or send you information about products or services. In addition, sometimes we hire companies to help deliver products or services, such as a third-party prize provider for a sweepstakes. In those instances, there is a need to share your information with these companies. We may also use information collected through the Sweepstakes for research regarding the effectiveness of Sweepstakes and our business planning, marketing, advertising, and sales efforts.  

We may also take your Personal Information and make it non-personally identifiable, either by combining it with information about other individuals, or by removing characteristics (such as your name) that make the information personally identifiable to you. There are no restrictions under this Privacy Policy upon our right to aggregate or de-personalize your personal information, and we may use and/or share the resulting non-personally identifiable information with third parties.

We may also use and disclose the Personal Information we collect to:

• send you product or service information
• respond to customer service requests
• send you newsletters, text messages or email communications
• respond to your questions and concerns
• improve our services and marketing efforts
• conduct internal quality improvement or business analysis
• To fulfill or meet the reason you provided Personal Information to KST, such as to enter a sweepstakes.
• To communicate with you, including via e-mail, text message, push notification, social media and/or telephone calls. We may retain your e-mail, e-mail address and our responses to you. This information is used to answer your follow-up questions and measure how effectively we address your concerns.
• To assist with calls made to our representatives or visits made to our office locations. We may collect and combine Personal Information from other sources with Personal Information that you provide online.
• To personalize your experience and to deliver custom content and service offerings relevant to your interests, including targeted offers and ads through our website, mobile apps, communications, third-party sites, or on other devices you may use. We may ask you to voluntarily provide us with information about your interests, demographics, experience with our services and contact preferences to help customize offerings to you.
• If you send us a resume or curriculum vitae ("CV") to apply online for a position with KST, we will use the Personal Information that you provide to match you with available KST job opportunities.

We may use your Personal Information in connection with other products, services, promotions, personalized ads, or contests we may offer, and for our internal reporting and statistics. We may share or disclose your Personal Information with our professional advisors, potential transaction partners, or other third parties.

We may also disclose Personal Information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property.

Messages and Communications

By providing a telephone number, you expressly consent and authorize us, as well as any of our related affiliates, agents or contractors, to contact you through the use of any dialing equipment (including a dialer, automatic telephone dialing system, and/or interactive voice recognition system) and/or artificial or prerecorded voice or message. You expressly agree that such automated calls may be made to any telephone number (including numbers assigned to any cellular or other service for which you may be charged for the call) you provide. In addition, you expressly consent and authorize the receipt of text messages from us at any telephone number (including numbers assigned to any cellular or other service for which you may be charged for the call) you provide. By providing this express consent, you specifically waive any claim you may have for the making of such calls or texts, including any claim under federal or state law and specifically any claim under the Telephone Consumer Protection Act, 47 U.S.C. § 227. By providing a telephone number, you represent you are the subscriber or owner or have the authority to use and provide consent to call or text the number.

By providing your email address, you expressly opt-in to the receipt of email communications from us and our affiliates, agents, or contractors for or related to goods or services, your account, and other services. By providing this express consent, you specifically waive any claim you may have for the sending of such emails, including any claim under federal or state law and specifically any claim under the CAN-SPAM Act, 15 U.S.C.§ 7701, et seq. By providing an email address, you represent you are the subscriber or owner or have the authority to use and provide consent to contact the email address.

Third Party Services

KST uses Google Docs for sweepstakes submissions and survey forms. You can review Google's Privacy Policy here: https://policies.google.com/privacy?hl=en-US. KST also may interact with you through our content on social media platforms, such as Facebook and Instagram. For a description of how social media services and other third-party platforms, plug-ins, integrations or applications handle your information, please refer to their respective privacy policies and terms of use, which may permit you to modify your privacy settings. This Privacy Policy does not cover the use of your Personal Information by any third parties, so be sure to review the privacy policy of any third-party websites you visit.  

Data Retention

We will retain your Personal Information for our business records and for the sales and marketing functions of our company, unless prohibited under applicable law.

Purchase or Sale of Businesses

We may buy, merge, or partner with other companies or businesses and in so doing, acquire or transfer information. We may also, sell, assign, or otherwise transfer such information in the regular course of business. Information collected through the Sweepstakes may be among the transferred business assets. In the event that a portion or substantially all of our assets are sold or transferred to a third party, your information would likely be a transferred business asset, and you hereby agree to such a transfer.

In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.

Additional Disclosures

We will disclose personal information when we believe in good faith that such disclosures are required by law, including, for example, to comply with a court order or subpoena; to enforce our Privacy Policy; to protect your safety or security; and/or, protect the safety and security of our websites, us, and/or third parties, including the safety and security of property that belongs to us or third parties. We may disclose personal information to any person performing audit, legal, operational, or other services for us.

Non-Personal Information

We may use and share non-personal information – that is, de-identified information - for any lawful business purpose without any obligation or accounting to you.  For example, we can use non-personal information for developing products, services, and providing those offerings to other users and third parties. We may use your personal information to generate non-personal information. When we do so, we will take reasonable measures to ensure that the non-personal information is no longer personally identifiable. We may also disclose non-personal, aggregate, anonymous data in a de-identified format based on information collected from users to investors, and other third parties.

Children's Information

We do not knowingly collect any information from, or sell to, children under the age of 13. If you are a parent or guardian who has discovered that your child under the age of 13 has submitted his or her Personal Information without your permission or consent, please contact us and we will remove the information at your request.

Changes and Updates

We may revise this Privacy Policy from time to time as we add new features or modify the way in which we manage information, or as laws change that may affect our services. If we make material changes to our Privacy Policy, we will post notice of this prior to the changes becoming effective. Any revised Privacy Policy will apply both to information we already have about you at the time of the change, and any personal information created or received after the change takes effect. We include a version number on this Privacy Policy consisting of the date (year, month, and day) it was last revised. We encourage you to periodically reread this Privacy Policy, to see if there have been any changes to our policies that may affect you. Your continued participation in the Sweepstakes after any such changes constitutes your acceptance of the new Privacy Policy. If you do not agree to this Privacy Policy or any future Privacy Policy, do not participate (or continue to participate) in the Sweepstakes.

Do Not Track

We currently do not participate in any "Do Not Track" frameworks that would allow us to respond to signals or other mechanisms from you regarding the collection of data.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, Virginia, and other states may provide (now or in the future) their state residents with rights to:

• Confirm whether we process their personal information.
• Access and delete certain personal information.
• Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose (excluding Iowa and Utah).
• Data portability.
• Opt-out of personal data processing for:
  • targeted advertising (excluding Iowa);
  • sales; or
  • profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).
• Either limit (opt-out of) or require consent to process sensitive personal data.

We may have a reason under the law why we do not have to comply with your request or may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response.

Please note that, in order to verify your identity, we may require you to provide us with information prior to accessing any records containing information about you.

International Privacy Laws / Storage and Transfer of your Data

KST is a U.S.-based company. If you send KST information or access its services, please be aware that you are sending information (including potentially Personal Information) to the United States. Any information sent to KST will be held in accordance with privacy laws in the United States and this Privacy Policy.

EEA/Switzerland/UK Data Transfers

KST is a U.S.-based company with no EEA/EU/UK establishments at this time. If you are a resident of another country, note that the United States and other countries may not afford the same privacy protections as your country of residence.

Special Notice to EEA, UK and Switzerland Citizens and Residents

If you are a citizen of or reside in the EEA, Switzerland, or the UK, you may be entitled to certain rights, subject to applicable exceptions, under the GDPR, Swiss, and UK data protection laws.
